SC: REGISTRATION OF FAMILY SETTLEMENT NOT COMPULSORY

 

On 01.10.2021, the Division Bench of the Hon’ble SC of India in the case Korukonda Chalapathi Rao & Ors v Korukonda Annapurna Sampath Kumar [CIVIL APPEAL NO(S).6141 OF 2021
(Arising out of SLP(C) NO(S).25745 OF 2016)] 
held that REGISTRATION OF FAMILY SETTLEMENT NOT COMPULSORY under Section 17(1)(b) of the Registration Act, 1908 unless such settlement creates, declares, limits or extinguishes rights in the immovable properties.

The Court further held that, therefore, such a document will not be hit by the bar under Section 49 of the Registration Act.
